Terms of Service

Who we are & acceptance

These Terms of Service (the “Terms”) govern your use of mxmacro.com(the “Site”), operated by MxMacro LLC (“MxMacro,” “we,” “us”). By using the Site, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site. Our services to clients are governed by a separate written service agreement between MxMacro LLCand the client (the “Service Agreement”); if these Terms and a signed Service Agreement conflict, the Service Agreement controls for that client. Our services are business-to-business: the Site and everything we sell are offered for commercial use by businesses, not for personal, family, or household purposes.

Using the site

Use the Site for lawful purposes only. Don't interfere with its operation, probe or test its security, scrape it at scale, submit forms with someone else's information or automated tools, or use the Site to send spam or unlawful communications. We may suspend access that breaks these rules.

Our content & trademarks

The Site and its content, including text, design, graphics, and code, are owned by MxMacro LLC or its licensors and protected by intellectual-property laws. MxMacro, MxCrew™, MxEngine™, and MxRocket™, and their logos, are trademarks of MxMacro LLC. You may view and share links to the Site freely; don't copy, republish, or use our content or marks commercially without written permission.

Working with us

The full terms of any engagement live in the Service Agreement you sign, but the promises we make on this Site are real, and the Service Agreement is written to keep them:

• Month-to-month.Plans renew automatically each month at the agreed rate until cancelled, and either side can cancel with 30 days' written notice (an email counts). There are no long-term contracts.
• You own everything that's yours. Your ad accounts, phone number, website, customer lists, and CRM data belong to you from day one and leave with you.
• Our tools stay ours.The pre-existing software, frameworks, and templates we use to deliver the work (including MxEngine™ and MxRocket™) remain our property; you get the outputs, not the machinery.
• Ad spend is yours, directly. You pay Google, Meta, and other platforms from your own accounts. We never hold your ad budget and never mark it up.
• Setup fees are one-time and non-refundable once onboarding work begins, as described in the Service Agreement. Monthly fees stop when a cancellation takes effect.

Calls, texts & email

When you submit a form on the Site, book a call, or otherwise give us your contact details, you agree that MxMacro may contact you about your inquiry and our services by phone, text message (SMS), and email, including with the help of automated technology. Consent is not a condition of buying anything. Message frequency varies with your inquiry, and message and data rates may apply. Reply STOP to any text to stop texts, and HELP for help; every marketing email includes an unsubscribe link. See our Privacy Policy for how we handle your information, including that we never share your SMS consent with third parties.

Client responsibilities

Our services help clients communicate with theircustomers, and clients control those campaigns. If you become a client: you are the sender and initiator of communications made through your accounts; you're responsible for having the consents the law requires (including under the TCPA and state telemarketing laws) before calling or texting anyone, for honoring opt-outs, and for the accuracy and legality of content you approve. We provide software, configuration, and management, not consent, and never supply contact lists. The Service Agreement covers this allocation in detail.

Information & estimates

Content on the Site is for general information. Tools like our missed-call calculator produce estimates from the inputs you provide and cited industry benchmarks; they are not a measurement of your business or a prediction of results. Every business is different, and we do not guarantee leads, bookings, rankings, or revenue, on this Site or anywhere else.

Third-party services

The Site links to and embeds third-party services, for example our scheduling provider (Cal.com) for booking calls. Your use of those services is governed by their own terms and privacy policies, and we're not responsible for them. The ad platforms, review platforms, and phone carriers our services work with are also independent: their rules, pricing, and availability can change and are outside our control.

Waitlists & upcoming products

Products shown as “coming soon” (like MxEngine™ and MxRocket™) are in development. Joining a waitlist means we'll email you about that product's progress, launch, and launch pricing; you can unsubscribe anytime. A waitlist spot isn't a purchase or a commitment by either of us, and features, pricing, and timing may change or be cancelled before launch.

Disclaimer

The Site is provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We don't warrant that the Site will be uninterrupted, secure, or error-free, or that its information is complete or current.

Limitation of liability

To the fullest extent permitted by law, MxMacro LLCand its founders will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, arising from your use of the Site; and our total liability for claims relating to the Site (not services under a Service Agreement, which has its own terms) will not exceed one hundred U.S. dollars ($100). Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you; nothing here limits liability that cannot lawfully be limited. If your misuse of the Site causes a third-party claim against us, you'll cover the resulting costs.

Governing law & disputes

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. If something goes wrong, email admin@mxmacro.comfirst: both sides agree to try in good faith to resolve any dispute informally for 30 days before filing anything. Disputes about the Site that can't be resolved informally will be brought in the state or federal courts serving Fairfax County, Virginia, and both sides consent to their jurisdiction. Disputes under a Service Agreement follow the dispute terms in that agreement.

Changes & contact
